Artwork Submission Terms

1. Ownership
All artwork submitted to Prism Arts Philadelphia (“the Gallery”) remains the sole property of the submitting artist (“the Artist”). The Gallery does not claim or obtain ownership, copyright, or intellectual property rights in the submitted work(s).

2. Usage Rights
By submitting work(s), the Artist grants the Gallery a non-exclusive, limited license to:

  • Exhibit the artwork in physical and/or digital spaces curated by the Gallery.

  • Photograph or reproduce the artwork for purposes of marketing, promotion, press, and archival documentation of the exhibition they are submitting the artwork for.

  • Use the Artist’s name, biography, and images of the work(s) with appropriate credit in connection with the exhibition they are submitting the artwork for.

Any use beyond the scope outlined above requires the prior written consent of the Artist.

3. Liability
While the Gallery will take reasonable care in handling and displaying submitted work(s), the Artist acknowledges that the Gallery is not responsible for loss, theft, or damage to the work(s) except in cases of gross negligence. Insurance coverage, if desired, is the responsibility of the Artist unless otherwise agreed in writing.

4. Withdrawal
The Artist may not withdraw submitted work(s) from the exhibition once accepted, except with written consent from the Gallery.

5. Agreement
Submission of artwork constitutes acceptance of these terms in full.

6. Sales and Commission
All sales of artwork during the exhibition will be facilitated by Prism Arts Philadelphia. The Artist agrees that the Gallery shall retain a thirty percent (30%) commission on the final sale price of any work sold, with the remaining seventy percent (70%) remitted to the Artist. Payment to the Artist will be issued within [1] day following the close of the exhibition or the completion of the sale, whichever comes first.
